I had it under use till term.\u201d<\/i><br \/>\n<i>The first: \u201cI was afar, away in other places, not able to challenge your usurpation.\u201d<\/i><br \/>\n<span style=\"padding-left: 60px;\"><b><i>Others interpret<\/i><\/b><i>: \u201cI was here the whole time, dwelling in the<\/i><\/span><br \/>\n<span style=\"padding-left: 60px;\"><i> inner rooms.\u201d<\/i><\/span><br \/>\n<i>They appeared before Rav Na\u1e25man.\u00a0<\/i><br \/>\n<i>He said: \u201cGo, clarify your use.\u201d<\/i><br \/>\n<i>Rava, then retorted: \u201cIs this truly the law? One who wishes to extract from his fellow, upon him is the burden of proof.\u201d (Babylonian Talmud, Baba Bathra, 29b)<\/i><\/p>\n<p>To own is to hold. To grasp with quick fist.<br \/>\nTo drive a stake into hard ground. To bound.<br \/>\nTo limn. To limit.<br \/>\nTo own.<br \/>\nTo contest is to get between to challenge to<br \/>\nquery to dare<br \/>\nto lie<br \/>\nto contest.<br \/>\nThe land<br \/>\n<span style=\"padding-left: 60px;\">inert it stays where it was<\/span><br \/>\n<span style=\"padding-left: 60px;\">property implies perhaps that it was<\/span><br \/>\n<span style=\"padding-left: 60px;\">seeded with sweat and now impregnated<\/span><br \/>\n<span style=\"padding-left: 60px;\">with the life of the owner.<\/span><br \/>\nIt happened in Nehardea. It did.<br \/>\nTwo men, real men,<br \/>\nbandanas and cowboy hats. One maybe<br \/>\nhad a John Deere cap. Sweated through around the band.<br \/>\nThe conversation was anything but hale friends well met.<br \/>\nThe conversation was pointed<br \/>\n<span style=\"padding-left: 30px;\">disjointed<\/span><br \/>\n<span style=\"padding-left: 60px;\">angry<\/span><br \/>\n<span style=\"padding-left: 90px;\">sharp<\/span><br \/>\nWhat are you doing on my land son?<br \/>\nYou sold it to me.<br \/>\n<span style=\"padding-left: 30px;\"><i>Say it like this:<\/i> YOU SOLD IT TO ME MOTHERFUCKER!!<\/span><br \/>\n<span style=\"padding-left: 30px;\"><i>Say it like this: <\/i>But you\u2026 you sold it to me.<\/span><br \/>\n<span style=\"padding-left: 30px;\"><i>Say it like this: <\/i>Don\u2019t you remember, old man, I <\/span><br \/>\n<span style=\"padding-left: 30px;\">bought it from you. I tilled it <\/span><br \/>\n<span style=\"padding-left: 30px;\">till my arm near fell off, I planted it and harvested it. Three years<\/span> <span style=\"padding-left: 30px;\">now. I bought it from you, old man.<\/span><br \/>\n<span style=\"padding-left: 30px;\">Now leave.<\/span><\/p>\n<p>It happened like this<br \/>\nof a day. a very certain day<br \/>\non a field. a specific field<br \/>\nit happened like this<br \/>\na certain man and another man<br \/>\ntwo men. no other men.<br \/>\ntwo men facing each other over a piece of land<br \/>\nmy land. my land<br \/>\nwas your land I bought it from you<br \/>\nImpossible I was not here<br \/>\nImpossible I was on it all the while<br \/>\ntwo men. facing each other<br \/>\nface to face<br \/>\nstanding before the law. before a very specific law<br \/>\nbefore Rav Na\u1e25man. before Rava<br \/>\nRava also before Rav Na\u1e25man<br \/>\nsetting the case before the law<br \/>\nsetting the land before the law<br \/>\nRav Na\u1e25man speaks. Clarify your hold.<br \/>\n<span style=\"padding-left: 60px;\">Make it clear to me that you had possession.<\/span><br \/>\n<span style=\"padding-left: 60px;\">make it clear to me that you had sole possession.<\/span><br \/>\n<span style=\"padding-left: 60px;\">make it clear to me that the land is yours<\/span><br \/>\n<span style=\"padding-left: 30px;\"> Rava. student. questions.<\/span><br \/>\n<span style=\"padding-left: 30px;\"> is this the law?<\/span><br \/>\n<span style=\"padding-left: 30px;\"> the books say that the one who extracts must bring proof.<\/span><\/p>\n<h2><i><\/i>II<\/h2>\n<p><i>It happened in Me\u1e25oza.<\/i><br \/>\n<i>That one man who said to his fellow: What are you doing in this house?<\/i><br \/>\n<i>He replied: I bought it from you and have enjoyed the years of legal ownership.<\/i><br \/>\n<i>He said: I was in distant markets!<\/i><br \/>\n<i>He replied: Behold I have witnesses that each and every year you would come to market for thirty days.<\/i><br \/>\n<i>He said: All thirty days I was occupied with the market.<\/i><br \/>\n<i>Said Rava: It does happen that all thirty days one would be occupied with the market.\u00a0<\/i><br \/>\n<i>(Babylonian Talmud, Baba Bathra, 30a)<\/i><\/p>\n<p>It is the lure of the easy metaphor<br \/>\nthe lure of the market ignoring the house<br \/>\npreoccupied with the marketplace you have forgotten who<br \/>\nwas in your house. preoccupied. engrossed. It happened.<br \/>\nin Me\u1e25oza. With one specific person<br \/>\nand another specific person.<br \/>\nand Rava decided that that is what people do.<br \/>\nin Me\u1e25oza. only in Me\u1e25oza?<\/p>\n<p>I was away in foreign lands, not the lure of adventure<br \/>\nit wasn\u2019t the white sands, just the daily search for bread,<br \/>\nIt wasn\u2019t that home slipped my mind, that ever I didn\u2019t think<br \/>\nof Me\u1e25oza and those left behind, its just that I was ever so<br \/>\nbusy, the busyness that is life, running after the deal<br \/>\navoiding the pain, the strife, you were on my mind<br \/>\nreally. It happened. But I wasn\u2019t in Mehoza.<\/p>\n<p>and yet you were. and even when you were.<br \/>\nyou weren\u2019t.<br \/>\n<span style=\"padding-left: 60px;\">and yet you were. and even when you were.<\/span><br \/>\n<span style=\"padding-left: 60px;\">you weren\u2019t.<\/span><\/p>\n<p>but that is still too easy. the metaphor falls breaks<br \/>\ndissolves into dust on the stairs of the courthouse<br \/>\non the rhetoric of the courthouse and the anger<br \/>\nof the law: What are you doing here?<br \/>\nI have a claim<br \/>\nI was unable to dispute<br \/>\nI have witnesses<br \/>\nI was unavailable<br \/>\n<span style=\"padding-left: 30px;\">Yes. It happens.<\/span><br \/>\nwe are though still captured by the metaphor<br \/>\ntake it on then, break it open.<br \/>\nwhat is a house? if you were in foreign lands for these many years<br \/>\n<span style=\"padding-left: 90px;\">it was not a home<\/span><br \/>\n<span style=\"padding-left: 90px;\">it was a piece of property<\/span><br \/>\nyet here I was. I ate those years. I enjoyed those years<br \/>\nI made a home and memories.<br \/>\nyou could have come back<br \/>\nwhat gates or walls did I erect?<br \/>\nwhat bill of divorce did I send you?<br \/>\nI paid in blood sweat and tears<br \/>\nI paid in the laughter of little children<br \/>\n<span style=\"padding-left: 30px;\">the cries of skinned knees and broken expectations<\/span><br \/>\n<span style=\"padding-left: 30px;\">the glass of merlot at the end of the day<\/span><br \/>\n<span style=\"padding-left: 30px;\">the sunsets<\/span><br \/>\nyou paid market prices. you waged marketfare.<br \/>\nwhat have we now but Rava\u2019s final decision<br \/>\nand he\u2019s decided. it happens betimes. just like this.<br \/>\nin Me\u1e25oza. it happens. we are not unique.<br \/>\nit happens.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A Talmudic diptych For Holly on her 66th birthday.
